Breaking news from France: court orders TotalEnergies to include Scope 3 emissions in its vigilance plan

In a significant legal setback for TotalEnergies SE, a French court has ruled, in a case brought by the environmental group Notre Affaire à Tous (NAAT), that the company must supplement its current corporate vigilance plan within six months of being formally notified of the decision.

The ruling requires the oil and gas giant to incorporate Scope 3 greenhouse gas emissions into its risk mapping and related prevention and mitigation measures, in line with Article L.225-102-1 of the French Commercial Code.

Scope 3 emissions refer to indirect emissions generated across a company’s entire value chain, including those resulting from the use of its sold products such as fuels and energy. For major oil and gas companies, these emissions typically represent the largest share of their overall carbon footprint.

The decision is widely seen as a landmark in corporate climate accountability, strengthening the legal obligation for large companies to identify, prevent, and mitigate environmental impacts across their operations and value chains. (Moz24h)
